Promotional Free Months

Any promotional free months offered as part of a plan purchase will be applied at the end of the contract term. However, these free months are contingent upon the renewal of the contract before it expires. If the contract is not renewed prior to the expiration date, the free months will be forfeited.

Use of AI Services

To enhance our services and improve your customer experience, Zoom Auto Protect may use AI-powered tools and automation for tasks such as:

Generating quotes.
Processing claims.
Providing customer support.

By using our services, you consent to the use of these AI tools to facilitate and optimize service delivery. While AI services are carefully monitored and maintained, Zoom Auto Protect is not liable for minor errors or omissions resulting from their use.

Data Usage for Quotes and Communications

By providing your personal information (name, phone number, email address, etc.) for a quote or inquiry, you expressly consent to:

The collection, use, and storage of your data in accordance with our Privacy Policy.
Receiving communications from Zoom Auto Protect via phone calls, text messages, emails, and automated calls.

This consent applies regardless of whether your contact information is listed on federal, state, or other "Do Not Call" registries. You acknowledge and agree that such communications may be necessary to provide quotes, respond to inquiries, and deliver updates related to our services.

Ownership of Data

Contracts automatically renew unless the user opts out at least 30 days before the renewal date. Renewal notifications will be sent via email 60 days prior to the expiration of the current contract.

Prohibited Activities

Users agree not to engage in the following prohibited activities while using the website or services:

Data Scraping: Attempting to extract data from the website through automated tools or manual methods.
Reverse Engineering: Attempting to deconstruct or reproduce proprietary tools or software.

Fraud and Termination

Examples of Fraudulent Activity:

Misrepresentation of Vehicle Condition: Concealing pre-existing issues, falsifying mileage, or submitting false documentation.
Submission of False Claims: Filing fraudulent repair claims or altering invoices.
Unauthorized Use: Transferring a contract to an ineligible party.
Identity Theft: Using another person’s identity without authorization.
Collusion: Collaborating with repair facilities to fabricate claims or inflate repair costs.

Consequences of Fraud:

Immediate Termination of Contract: The service contract will be canceled without a refund.
Legal Action: Zoom Auto Protect may pursue legal remedies, including prosecution to the fullest extent of the law.
Forfeiture of Future Services: The user will be permanently barred from accessing services.

Chargeback Policy

Zoom Auto Protect has a strict policy against unauthorized or frivolous chargebacks.

1.) Resolution Requirement: Users are required to contact Zoom Auto Protect at billing@zoomautoprotect.com to resolve disputes before initiating a chargeback.

2.) Unauthorized Chargebacks:

Chargebacks initiated without first attempting to resolve the issue with Zoom Auto Protect will be considered unauthorized.
Users may face service termination and be held responsible for any chargeback fees incurred by the Company.

3.) Legal Action: The Company reserves the right to pursue legal action or involve collections agencies to recover disputed funds.

Negative or Bad Reviews

Zoom Auto Protect welcomes constructive feedback but has a zero-tolerance policy for false, defamatory, or malicious reviews intended to harm the Company’s reputation.

2.) Defamatory or False Reviews:

Users who post false or defamatory reviews may face legal action, including claims for damages.

Zoom Auto Protect reserves the right to cancel a user’s contract under the following circumstances:

1.) Commercial Unviability: If providing service becomes commercially unviable due to changes in the market or service conditions.

2.) Violation of Terms: If the user is found in violation of these Terms and Conditions, including fraudulent activity or harassment.

3.) Misrepresentation: If the user provides false or misleading information during the application or claims process.

In the event of cancellation, users may receive a prorated refund based on unused coverage unless fraud or misconduct is involved, in which case no refund will be issued.

Arbitration and Jurisdiction

All disputes arising under these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration will be conducted in the State Of Delaware.

Class-Action Waiver

Users waive their right to participate in any class-action lawsuits against Zoom Auto Protect.

If arbitration is not enforceable in certain jurisdictions, disputes shall be resolved exclusively in the courts of Delaware.

Severability Clause

Limitation of Liability
